Victims of Crime - compensation coming

David rang the New South Wales victims of crime people earlier to ask about what's happening with the compensation for the psycho nephew bashing. They said the court papers had arrived there today and it would take a couple of weeks to go through an assessment process, whereupon they would inform him of the amount granted.

We have no idea how much it will be, not expecting a lot as I think there was a change in the legislation a while ago to put a cap on the damages awarded, but it'll be a few thousand we expect. Not a lot for what David and I have been through over it all, but at least will be something.

The best thing about it is that whatever the amount paid to David the NSW gov then goes after psycho for it. Even just $5,000 would be a lot of money for anyone to have to fork out. Good fuckin job.
A provisional order is the first step in the restitution process. The order is made by the Commissioner of Victims Rights to notify the defendant that an award for compensation or victims support payments have been made to a victim and the Commissioner is seeking to recover the amount of the award or victims support payments from the defendant. 

An award of compensation and victims support payments are paid from State funds and will have been paid to the victim before restitution action is commenced. Awards for compensation are comprised of components for injury sustained and actual expenses arising therefrom. Victims support payment are comprised of payments made to victims for financial support and/or recognition payment. 

The provisional order sets out: 
  • the amount and date of the award/or victims support payment 
  • the name of the victim 
  • the injury(ies) sustained by the victim and 
  • relevant conviction details more
