Bogus AVO

We got home from court yesterday afternoon a bit after 5pm. David had been released with some incredibly mild bail condition, no money just to stay residing here. The magistrate was pretty surprised at how bizarre this case was. An Apprehended Violence Order filed last June, of which he never received the summons to court, of which the warrant for failing to appear wasn't issued until a full 14 months later.

For a start it's a bit hard to turn up to a court date that you don't know about. He simply didn't know. But the 14 months in between that failing to appear, and the arrest warrant being issued, is bizarre. Surely this has to be some kind of weird mistake.

The AVO application itself isn't even legit. The guy involved in it was using the AVO system to get back at David after David split up with him. This guy used David's HIV against him, at one point saying he was "risking his life" being with him. After a while however David found out that he was also positive, and had been the whole time since they'd met. Needless to say that was the end of the relationship. Gays can be bitches darlings.

So the guy faked falling over a few months later when they bumped into each other by chance, and then put in a AVO application. It was simply a way to get back at David, sadly giving a bad name to genuine AVO applications like mine was.

David is back in court this Friday to put an end to it. I'm gonna help him put a statement together about it all for the magistrate to read about it all, as it's not good having the whole courtroom know about your HIV is it. I have statement writing experience from my own court dates in the past.

The fact remains however, that completely innocent David was taken from his home at about 8am and had no contact with loved ones all day until he turned up through the side door of the courtroom at 4pm. All over a bogus AVO application from June 2012. I don't see why I wasn't allowed to see him, or even just talk to him on the phone. I was worried about his mental state as he's been depressed lately and this sure wasn't going to help. To not even to be able to have contact with me was wrong. Surely even just a visit of a few minutes would've been OK.
